Terms of Service

1. Agreement to these Terms

By accessing or using the Services, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services. Additional terms or notices may apply to particular features, business services, promotions, or third-party integrations. If additional terms conflict with these Terms, the additional terms control for the feature they specifically cover.

2. Eligibility and accounts

You may use the Services only if you can lawfully enter into these Terms and are not prohibited from using the Services under applicable law. If you use Sentient for or on behalf of an organization, you represent that you have authority to bind that organization to the terms that apply to its use.

You are responsible for information and actions associated with your account and for protecting your devices, recovery information, authentication information, and other account-access mechanisms. Do not share account-access or recovery information in a way that would allow another person to impersonate you or take control of your account.

2A. Age eligibility and guardian linking

Sentient is intended for people age 13 and older. People under 13 are not eligible to use this version of Sentient and may not create an account. If the date of birth entered during sign-up shows that the person is under 13, sign-up stops and is paused on that device for 72 hours. You may not provide false age or date-of-birth information to get around these requirements. If we learn that an account belongs to someone under 13, we may disable the account and permanently delete it and its data.

People ages 13 through 17 may use Sentient only after completing Sentient's parent or guardian linking process during account setup; the account is not created until linking succeeds. Guardian linking is tied to an adult Sentient account, meaning one whose stated date of birth shows the account holder is 18 or older. As part of that process, the guardian must consent to the dependent creating and using a Sentient account. The dependent must also agree to these Terms and acknowledge our Privacy Policy when the account is created. By giving consent, the adult confirms that they are the dependent's parent or legal guardian, or are otherwise authorized to give that consent. Sentient does not independently verify that relationship. Our Privacy Policy describes how linking works and what information it uses.

While a dependent is under 18, the linked guardian may control whether the dependent can continue to use Sentient, using the family controls in the app. When access is turned off, the dependent cannot use Sentient until access is turned back on. When a dependent turns 18, the guardian's access-control authority ends and the account continues as an independent adult account. If the linked guardian deletes their own account while the dependent is under 18, the dependent's account is not deleted. It is restricted until a new parent or guardian is linked through the same process, or until the original guardian cancels their deletion.

The guardian and dependent access controls are separate from Sentient's moderation and safety enforcement. They do not replace, limit, or override any warning, suspension, restriction, or other measure Sentient may apply to an account under these Terms.

3. Acceptable use

You may not use the Services to:

• impersonate another person or organization, misrepresent identity or authority, or facilitate fraud;
• phish, scam, deceive, harass, threaten, exploit, stalk, or unlawfully surveil another person;
• send malware, malicious code, unlawful content, or content intended to compromise a device, account, or system;
• circumvent security, device-integrity, authentication, rate-limit, access-control, or anti-abuse measures;
• probe, scan, reverse engineer, disrupt, overload, or interfere with the Services except to the extent a restriction is prohibited by applicable law;
• use automated systems to create abusive accounts, scrape protected data, spam users, or conduct unauthorized bulk activity;
• violate another person’s privacy, intellectual-property, publicity, contractual, or other rights;
• record, upload, disclose, or process communications without the rights, permissions, or legal authority required to do so; or
• use the Services for any unlawful purpose or to help another person do any of the above.

4. Communications, verification, and security features

Sentient provides tools intended to help users establish and manage trusted communications. Verification, device-integrity, business-registry, encryption, security, and identity-related features reduce certain risks but do not eliminate every risk. A verified organization, trusted contact, security indicator, or successful technical check is not a guarantee that every communication, employee, device, request, or future action is legitimate or safe.

You remain responsible for evaluating sensitive or unusual requests, particularly requests involving money, credentials, recovery information, identity documents, account changes, or other consequential actions.

5. Sentient AI and Deepfake Detector

Sentient AI features may analyze content you intentionally submit, such as audio recordings, video recordings, screenshots, or imported conversations, for signals associated with synthetic or manipulated media, fraud, scams, phishing, impersonation, or social engineering.

Sentient AI is not a substitute for law enforcement, emergency services, a forensic expert, a financial institution, legal counsel, or another qualified professional. Do not rely on an AI result as the sole basis for a legal accusation, financial transaction, emergency decision, or other high-impact action.

You are responsible for ensuring that you have the rights and legal authority required to record, save, upload, or submit content involving other people. Recording and consent laws vary by jurisdiction.

6. Business and organization services

Organization administrators are responsible for their organization’s users, roles, permissions, departments, account configuration, and lawful use of the Services. Organizations must ensure that personnel who access Sentient are authorized to do so and must promptly update or remove access when it is no longer appropriate.

Business-registry review and onboarding are intended to reduce impersonation risk. Sentient may request information, documentation, or verification steps before approving or maintaining an organization account and may suspend or remove an organization that fails verification, presents a security or legal risk, or violates applicable terms.

7. Your content

You retain the rights you have in content you submit to the Services. You grant Sentient a limited license to host, transmit, process, reproduce, adapt, and otherwise handle that content only as reasonably necessary to operate, secure, support, and provide the Services, comply with law, and carry out actions you request.

You represent that you have the rights and authority needed to provide content to the Services and to permit the processing necessary for the feature you choose to use.

8. Sentient intellectual property

The Services, including Sentient’s software, design, branding, logos, interfaces, text, graphics, and other materials created by or for Sentient, are protected by intellectual-property and other laws. Except for rights expressly granted to you, Sentient and its licensors retain all rights in the Services.

These Terms do not grant you the right to use Sentient’s trademarks, logos, product names, or branding in a manner that suggests endorsement, affiliation, or authorization without permission.

9. Third-party services

The Services may rely on or connect with third-party infrastructure, operating systems, app stores, networks, websites, communications platforms, or other services. Sentient does not control third-party services and is not responsible for their independent terms, availability, security, content, or privacy practices.

10. Changes to the Services and Terms

We may add, change, suspend, or discontinue features as the Services evolve. We may also update these Terms. If a change is material, we will provide notice when required by applicable law. The effective date at the top of this page shows when these Terms were last updated.

11. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” SENTIENT DISCLAIMS WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.

We do not warrant that the Services will always be available, uninterrupted, error-free, completely secure, or capable of detecting or preventing every scam, impersonation attempt, deepfake, compromise, or fraudulent communication.

12. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SENTIENT DIGITAL, INC. AND ITS DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR RELATING TO THE SERVICES OR THESE TERMS.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited. Some jurisdictions do not allow certain exclusions or limitations, so parts of this section may not apply to you.

13. Indemnification

To the extent permitted by applicable law, if you use the Services on behalf of a business or organization, that business or organization agrees to defend, indemnify, and hold harmless Sentient Digital, Inc. and its directors, officers, employees, and affiliates from third-party claims, liabilities, damages, and reasonable costs arising from that organization’s unlawful use of the Services, its content, or its violation of these Terms or another person’s rights.

This business indemnity does not apply to an individual consumer solely because that person uses the consumer Services for personal purposes.

14. Suspension and termination

You may stop using the Services at any time and may use available account-deletion controls. Deleting your account in the app deactivates it immediately and permanently deletes it after 30 days, unless you cancel by signing back in during that period. If you cannot use the app, you can request deletion through our website. We may restrict, suspend, or terminate access when reasonably necessary to protect the Services or users, investigate abuse or security issues, comply with law, address nonpayment for paid services, or enforce these Terms.

Provisions that by their nature should survive termination — including provisions concerning intellectual property, disclaimers, limitations of liability, and disputes — will survive to the extent permitted by law.

15. Applicable law and mandatory rights

Your use of the Services is subject to applicable federal, state, local, and other laws. Nothing in these Terms waives consumer rights or remedies that cannot lawfully be waived. Any dispute-resolution, forum, arbitration, or choice-of-law provisions that may later apply to a specific paid or business service will be presented in the applicable agreement before they bind that service.
